ELIGIBILITY & PROHIBITED CONDUCT

Users must be at least 18 years of age and possess the legal authority to bind their organization. Prohibited conduct includes:

• Cyber-Attacks: Any attempt to breach our secure trade servers or administrative networks.
• Data Scrapping: The use of automated tools (bots/scrapers) to harvest commodity pricing or supplier lists.
• Fraudulent Misrepresentation: Providing false environmental certifications, fake trade licenses, or misleading "Proof of Funds" (POF).

TRADE DISCLAIMER & CONTRACTUAL SUPREMACY

• Informational Purpose: Website content is for guidance and does not constitute a binding offer.
• Contract Supremacy: All physical transactions are governed exclusively by a signed Sales & Purchase Agreement (SPA), which shall supersede any information on this website.
• Incoterms® 2020: All trade terms shall be interpreted according to the Incoterms® 2020 rules published by the ICC.

COMPLIANCE & GLOBAL TRADE REGULATIONS

• Anti-Corruption: We strictly adhere to the Canadian Corruption of Foreign Public Officials Act and UAE Anti-Bribery Laws.
• Sanctions: We do not trade with entities sanctioned under the Canadian Special Economic Measures Act, OFAC, or UN lists.
• Environmental Responsibility: Clients are solely responsible for ensuring their import of timber or agro-products complies with local forestry and agricultural laws.

LIMITATION OF LIABILITY & "AS-IS" PROVISION

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Warranties: We provide the website "As-Is" without warranties regarding market data accuracy.
• Indirect Loss: PGCO shall not be liable for Demurrage, Detention, or Loss of Market Profit due to price volatility.
• Liability Cap: Total aggregate liability for website-related claims shall not exceed CAD 2,000 / AED 5,000.

INTELLECTUAL PROPERTY

The "PGCO" brand, trade methodologies and sourcing algorithms are the exclusive property of PGCO International Trading Inc. or its parent, Pinnacle Groups FZE.

INDEMNIFICATION

You agree to indemnify PGCO against any claims, losses, or legal costs arising from your breach of these terms, your violation of environmental laws, or any fraudulent documentation provided to our compliance desk.

SEVERABILITY

If any provision is found invalid by a court, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid.

GOVERNING LAW & JURISDICTION

These terms are governed by the laws of the Province of British Columbia, Canada. Any disputes arising shall be subject to the exclusive jurisdiction of the courts located in Vancouver, British Columbia.

AMENDMENTS

PGCO International Trading Inc. reserves the right to update these Terms at any time. Changes are effective immediately upon posting.
